$1.2 Million Settlement Approved on Behalf of Assistant Restaurant Managers Employed by GPS Hospitality, LLC
Conway Legal is pleased to announce that nearly 500 current and former Assistant Restaurant Managers employed by the second largest Burger King franchisee in the United States, GPS Hospitality, LLC, stand to receive significant monetary benefits under a $1.2 million settlement that was approved today in the Superior Court of Cobb County, Georgia. The Plaintiff, Tammera Hill-Jones, claimed that Assistant Restaurant Managers were improperly classified as “exempt” from overtime, meaning that they were not paid overtime compensation for working more than 40 hours in a week. Hill-Jones claimed that the work performed by Assistant Restaurant Managers was the same as that performed by the hourly-paid, overtime-eligible associates working in the restaurant, including taking food orders, preparing food, cleaning the restaurant, working the drive-thru, helping customers, and ringing customers up on the cash register.
In reaching the settlement, Hill-Jones said “I’m glad that we were able to reach a wonderful settlement on behalf of such a large group of people. Assistant Restaurant Managers work hard and deserve to be paid overtime. I’m proud that with the help of Conway Legal we were able to resolve the case quickly and reach a settlement that will benefit everyone.”
Conway Legal’s managing partner, Jason Conway, said the settlement “reflects a superb recovery for several hundred employees. While GPS denies any wrongdoing, we are pleased that the parties were able to amicably resolve the matter and the professionalism demonstrated by both sides is to be commended.” Conway Legal undertook the case together with attorneys from the law firms of Levin, Sedran and Berman in Philadelphia and Buckley Beal in Atlanta.
