Senior Team Leaders at GetGo Cafe + Market Sue to Recover Unpaid Overtime

Together with co-counsel, Conway Legal today filed suit in federal district court in Indianapolis, IN, on behalf of a former “Senior Team Leader” at GetGo Cafe + Market who was not paid overtime compensation for working more than 40 hours in a workweek. The lawsuit alleges that Senior Team Leaders and Assistant Store Leaders at GetGo Cafe + Market (a part of Giant Eagle, Inc.) routinely work more than 40 hours a week in order to perform their job duties, yet are denied overtime compensation despite performing work that is substantially similar to those that are entitled to receive overtime. (Senior Team Leaders are now referred to as Assistant Store Leaders and the lawsuit includes individuals with job titles.)
The lawsuit alleges that Senior Team Leaders spent the majority of their time performing customer service, working on the cash register, stocking the shelves, preparing food, and cleaning the store. It also alleges that GetGo Cafe + Market has a policy, pattern, and/or practice of misclassifying Senior Team Leaders as exempt from overtime. The lawsuit seeks to recover all unpaid overtime owed to Senior Team Leaders who worked for Giant Eagle between July 10, 2015 and the present.
On October 28, 2020, the Court recommended granting Plaintiff’s request to send a notice to all other Senior Team Leaders employed by Giant Eagle to make them aware of the lawsuit and to give them an opportunity to join.
